By submitting an application, you represent and warrant that any financing requested is for business purposes only and not for personal, family, or household use.
2. SERVICES
The Site allows users to submit information in connection with requests for equipment financing and other commercial financing products.
The Company may act as:
• a lender
• a broker or referral source
• a facilitator of financing transactions
Submission of an application does not guarantee approval. All financing decisions are subject to the underwriting criteria of the applicable lender or financing partner.
3. CREDIT AUTHORIZATION AND DATA SHARING
By submitting information through the Site, you authorize the Company and its affiliates, lenders, banks, financial institutions, funding sources, and financing partners to:
• obtain consumer and/or commercial credit reports
• verify identity, financial, and business information
• evaluate your application for financing
You acknowledge and agree that:
• your application may be shared with multiple lenders and financing partners
• such parties may independently review your application
• such parties may obtain credit reports and additional information
• such parties may contact you directly
You further acknowledge and agree that financing agreements and related rights may be transferred, assigned, participated, or sold to lenders, financial institutions, or other third parties, and that your information may be shared in connection with such transactions.
You acknowledge that separate authorization for credit reports and related activities may be required and obtained through the application process.
4. ELECTRONIC COMMUNICATIONS (E-SIGN)
By using the Site, you consent to receive disclosures, agreements, notices, and communications electronically.
5. MARKETING AND COMMUNICATIONS CONSENT
We may use your personal information, including your email address, to communicate with you about your application, related financing transactions, and other products or services that may be of interest to you, where permitted by applicable law.
By providing your contact information to us, you acknowledge and agree that TFSWX LLC, its affiliates, and financing partners, including lenders and financial institutions, may contact you via telephone, text message (SMS/MMS), and email regarding your application, the processing of your request, and any resulting financing transaction.
We may also contact you via email regarding additional products, services, or promotions that may be of interest to you, in accordance with applicable law.
You understand and agree that:
• your application may be shared with multiple lenders and financing partners
• such parties may independently review your application
• such parties may contact you directly regarding your application or potential financing offers
You may opt out of receiving marketing emails by following the unsubscribe instructions included in such communications, and we will process such requests in accordance with applicable law.
Transactional or service-related communications (including calls, text messages, and emails) may still be sent as necessary to process your application or manage any resulting transaction or account.

6. USER CONDUCT
You agree not to submit false, inaccurate, or misleading information or misuse the Site.
7. THIRD-PARTY SERVICES
The Company may share your information with lenders, financial institutions, service providers, and other third parties in connection with evaluating, underwriting, funding, servicing, or transferring financing transactions. The Company is not responsible for the services, decisions, or actions of such third parties.
8. DISCLAIMER OF WARRANTIES
THE SITE AND SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. THE COMPANY DOES NOT GUARANTEE FINANCING APPROVAL.
9. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES.
10. ARBITRATION
Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved through binding arbitration on an individual basis.
